In this privacy statement, we explain how we collect and use your personal data. This privacy statement applies to all personal information that we process about you when you rent a yacht from us, use our services, visit our website, call us, email us, use our app, or otherwise interact with us.

Who is responsible

Tubber.com B.V., located and with its office at Friesestraatweg 211a, 9743 AD, Groningen, Netherlands (hereafter "Tubber.com", "we", "us", or "our") is - as the data controller - responsible for the processing of your personal data as described in this privacy statement, unless expressly stated otherwise.

Tubber.com shares the relevant personal data with the respective boat provider with whom you have made a reservation, and this boat provider will also act as a (co-)data controller upon receiving the relevant information. Tubber.com and each boat provider are each separately responsible for the processing of personal data, themselves or on their behalf, in accordance with applicable data protection legislation.

Furthermore, Tubber.com may share certain personal information with its affiliated group companies (for example, for customer service, fraud detection/prevention, or to comply with legal requirements) and trusted partners (including payment platforms and connectivity providers of Tubber.com). For these parties (who act as data processors on the basis of a processor agreement with Tubber.com), Tubber.com is responsible. The boat providers may also use data processors (such as payment platforms and connectivity providers) and are responsible for this.

Personal information

We may collect and process the following categories of personal information:

  • Name, address, telephone number, passport number (if required), and other identifying information (such as title, gender, and date of birth, nationality, country of residence, and passport number).
  • Your contact details and personal account or registration details. Your contact details may include your address, telephone number, and email address. When you create a login or register for our service, we may also record your login details and other information that you fill out on your account or registration form. Your account contains your personal settings (which can help you in planning, making, and managing your future bookings) and may also include photos and reviews from previous bookings.
  • Information about your outstanding and historical bookings. When you book a sailing holiday with us, we process your booking details. This information can include details about the boat, prices, and the date of your booking. In addition, we process information about your reservation (such as crew list and sailing license) and any additional services you purchase.
  • Information about your sailing holiday. When you travel with us, we process information about your trip. This includes your travel itinerary, (online) check-in, (mobile) voucher, and names/ages of crew members. We may also record any specified needs and any additional assistance you may require (such as any dietary preferences and mobility restrictions).
  • When we communicate with you. When you send us an email or chat with us online or via social media, we record your conversation with us. We also save your communication preferences. For example, if you unsubscribe from one of our newsletters or choose to receive your booking-related communication (such as confirmation, check-in notification, voucher, and changes to your Sailing Holiday) via other channels, such as WhatsApp or Facebook Messenger, Instagram, or SMS. When you contact us, our Service Center will note your inquiries or complaints in our customer database. We may also record or listen in live to telephone conversations for training and quality purposes. The recordings may also be used for handling complaints, legal claims, and the detection and prevention of fraud.
  • You may be invited to write or give a review about using our service(s) and your travel experience and the boat provider, to assist others in making their travel choices and bookings. If you write or give a review, we collect all the information you have added, along with your first name and place of residence. We may also invite you to participate in referral programs (where you can bring our service to the attention of a friend) or any contests from time to time.

Information we automatically collect when you use our website, app, and other digital media.

When you visit our site or use our mobile app, we may record your IP address, browser type, operating system, referring website, browsing behavior, language settings, and app usage (including date, time, and location and click behavior and pages visited). We also collect information through cookies and similar technologies when you visit our website or use our mobile app (see our cookie statement below for more information). Additionally, our system records how you made your reservation (on which (mobile) (partner or Tubber.com) website or app and from which site, link, or advertisement you came when you landed on our website, page, or app.

We may receive automatic notifications when you open our emails or click on a link in such emails.

With your permission, we may also obtain and use your location data in accordance with this privacy statement.

Information via social media

Depending on your social network settings, we may receive information from your social network provider. For instance, when you sign up for our services using a social network account, we may receive your social network profile, including your contact details, interests, and contacts. For more information about the personal data we collect from your social network provider and how you can change your settings, please consult the website and privacy policy of your social network provider (e.g., Facebook, Google+, and Instagram).

The information you choose to share with us

You may choose to share information with us, for example, when you share interests and preferences with us, leave a comment for us on Facebook or review websites, complete a customer survey, or submit an entry for an online contest.

Personal data of others that you share with us

In some cases, you may share personal data of others with us. It is your responsibility to inform the relevant individuals whose personal data you share with us, to make sure they understand for what purpose their data is used and what their rights are. It is your responsibility to obtain the relevant approval or consent from these individuals to share their personal data with us and to allow us to use it as described in this privacy statement.

Special Personal Data

Specific types of personal information that we collect and use, such as data revealing racial or ethnic origin or data concerning health, may be considered as 'special categories of personal data' under applicable data protection legislation.

It is possible that we need to collect, use, and share your special personal data with third parties for the purposes described in this privacy policy (see below). For example, to provide you with assistance or facilities during your sailing holiday that match your medical needs or your insurance during the sailing holiday.

Unless legally required, we will not ask for special personal data and advise you not to share this information (including your credit card details) without an explicit request from us.

For processing special personal data, other than for authentication or your profile picture (optional), we will always request your explicit consent (and indicate for what purpose this will be used).

If you choose to share special personal data with us without our explicit request, we will assume that by sharing this data, you have given your (explicit and unconditional) consent and permission for the processing of this data.

 

How we collect your data


We collect the previously mentioned categories of personal data in the following ways:


1. We collect data that you provide to us
When you book a sailing holiday with us, when you create an online account, contact our Service Centre, subscribe to receive our emails or mobile push notifications, register for one of our sailing holidays, or participate in a promotional contest. When you use our website or mobile app, we collect information through cookies and similar technologies.


2. From partners and other sources
We may also receive your personal data from our booking partners and other companies involved in facilitating your booking. We accept your data from these parties to handle your booking(s). For example, when you book a yacht through a partner portal, we receive your identification and booking details from them. Information we receive from partners may be combined with information provided by you to us.


Depending on your social network settings, we may receive information from your social network provider. See "The types of personal data we process" above.
Boat providers may also share information about you with Tubber.com. This can occur in cases of inquiries or issues related to your reservation.

 

Why We Use Your Data

Providing your personal data to Tubber.com is voluntary. However, we may only be able to provide certain services if we receive relevant personal data from you.

Our primary purposes for using your personal information are:

1. To provide our online services and mobile app

For instance, we use your name and booking details when you create an account. Through your account, you can easily manage your reservation, make new reservations, and manage your personal settings. You can also view special offers through your account.

We also use your relevant personal data for any (proactive and reactive) customer service, so we can contact you and/or the boat provider regarding any questions or issues related to your reservation, intended trip, or other (practical) questions.

Legal basis: processing of personal data is necessary for the performance of a contract (in particular, making, completing, and managing your reservation). Without the required personal data, the service offered (including reservation and customer service) cannot be provided. It is also in our legitimate interest to process your data for our communication with you (including customer service).

2. To deliver our services to you

To handle, complete, and manage your reservation (including possible communications such as booking confirmation, potential (payment/travel) reminders, and any changes and cancellations), we need to process and use most of the personal data described above. For example, we need your name, address, passport number, and other identifying information to issue your voucher and local papers to charter a yacht. To confirm your sailing holiday and to inform you about changes, we need your contact details. To ensure you receive the required care, we need your requested medical needs, if necessary.

In some cases, your personal data may also be processed to enable online check-in with your boat provider or for the payment and handling (including any refund) of possible security deposits. The relevant reservation details (including name, contact details, other relevant information or preferences) will be shared with the relevant boat provider.

We may also send you messages related to your reservation, such as our contact information if you need help or other information that we think may be necessary or helpful in planning your trip or relevant to your travel experience (including destination-related information, safety warnings, or travel restrictions). For example, before your sailing vacation begins, we will send you an email with a packing list, briefing, and crew list.

Some of our online services and our app use your location to show you, for example, the nearest gas station, restaurant, or the nearest marina and facilities.

If you have started an account or reservation but have not completed this process, we may contact you with an invitation to complete or finish this process. When you abandon your booking procedure on our website, we send you a personalized email with a link to your booking procedure so you can continue where you left off.

We may also make our services (including customer service) available through trusted distribution partners who make our services and products available on or through their platform. Your relevant personal data can be sent through this platform to us or by us to the platform to complete and possibly manage the reservation (including customer service). Please note: the processing of your personal data by the distribution partner is subject to the privacy statement of the distribution partner (as a data controller).

Legal basis: processing of personal data is necessary for the performance of a contract (in particular, making, completing, and managing your reservation). Without the required personal data, the service offered (including reservation and customer service) cannot be provided. It is also in our legitimate interest to process your data for our communication with you (including opening and managing an account).

Note: Boat providers process your personal data outside the control of Tubber.com. Boat providers, as data controllers, are themselves responsible for the data they process from you (via us or directly from you). Boat providers may also request additional personal data. Read (if available) the privacy statement of the boat provider to understand how they handle your personal data.

3. For internal reporting and analytical and statistical research

We use automated tools to conduct statistical research into general trends regarding the use of our services, website, app, and social media, and the behavior and preferences of our customers and users.

To carry out our research, we may use certain relevant personal data described above, including your sailing vacation data (such as date of booking, arrival time, origin, destination, number, and age of persons from your crew list, type of boat, purchased extras, and information about your gender, postcode). We combine these data with data we collect with cookies and similar technologies when you visit one of our websites or use our app. Furthermore, we combine certain relevant data collected by third parties through the use of analytical or marketing cookies or similar technologies.

To facilitate your use of our services, we may analyze and combine the data we collect when you use our digital media with information collected through cookies and related technologies. For example, to understand which digital channel (email, social media) or device (desktop, tablet, or mobile) you prefer so that we can limit our communication to that channel or medium.

We only use aggregated data for our analysis and do not use your name or email address. Without your express consent, we will not use sensitive data for this analytical research.

We use certain booking data from your sailing vacation and the extras you select to improve our service and to be able to make more suitable proposals to you. Additionally, we use surveys and customer reviews to measure user experience and customer satisfaction so that we can measure and possibly improve our products, services, and service (including the development and improvement of our machine learning models and artificial intelligence tools).

Cookies and similar technologies that we use to evaluate how our website visitors navigate through our site help us simplify the use of our platform.

Sometimes, we invite our customers to participate in market research. The invitation to such research will provide further information about why and for what purpose the requested information is collected and used. When using customer reviews (reviews), you can choose to display a name (or alias) with your review. By entering your name or alias, you agree that it may be displayed on our platforms. Legal basis: We process your data for our legitimate interest (including the legitimate interest of our partners) to develop better services and offers for our customers and partners, to provide more active customer support, and to improve our service (including the design and content of our websites and apps).

4. For Marketing Purposes

We use your information for marketing activities of our services and products (including news about travel-related products and services). You can easily and at any time unsubscribe from these email marketing communications. Furthermore, based on your information, personalized offers, promotions, and information may be shown to you on our website and app and on third-party websites and apps (including social media platforms).

Our websites use marketing cookies, typically placed by advertising networks. These networks are companies that act as intermediaries between Tubber and advertisers. These marketing cookies are used, among other things, to display relevant, personalized advertisements or sailing vacation offers (based on your visit to and click behavior on our websites) when you visit those networks or related websites. For example, if you visit our blog article about Greece, we will show you banners with specials from Greece.

If you log in to our website with your Tubber account or visit our websites via a link in an email, we link your site behavior to your Sailing Vacation booking details in our database. We primarily use this information to exclude you from further advertising once you have booked a sailing vacation. For instance, if you search on Tubber.com for a yacht in Croatia, marketing cookies are used to display relevant advertisements. Once you reserve a yacht through one of our other websites or at one of our brands, we will no longer show you further advertisements via marketing cookies based on your search behavior on our main website. We may use advertising partners and third-party platforms (comparison websites) for marketing and advertising activities. We may use your email address, IP address, and phone number for personalized advertisements from Tubber.com.

5. For Legal and Regulatory

Purposes In some cases, we must use your personal data to handle, resolve, or settle legal claims and disputes and to comply with our legal, fiscal, and administrative obligations.

Your data may also be used to comply with legal requests from law enforcement agencies or investigative inquiries and to prevent fraud or other illegal activities.

We may be legally required to collect and share your identification data and your booking and sailing vacation details with government agencies or government organizations for border control, immigration, entering the territory of a state, security, or counter-terrorism.

If you refuse to provide personal data that we need for your sailing vacation or to comply with a legal obligation, we may not be able to provide your sailing vacation or services you have requested from us. For example, we may need to cancel your sailing vacation without a refund. If you provide incomplete or incorrect information, we may deny you or the boat provider or authorities access to the boat, land, or port.

We may share your information with our professional advisers and any law enforcement / investigative and other government agencies.

Sharing Your Personal Data Within the Tubber.com Group and Based on Justified Interest

Your personal data may be shared within the corporate group of Tubber.com in order to offer our services (including for customer service, fraud detection and prevention, analytical purposes, and product improvement).

When personal data is used to serve the legitimate interests of Tubber.com or a third party, Tubber.com will always weigh your rights and interests in the protection of your personal data against the rights and interests of Tubber.com or that of the third party.

 

What Security Does Tubber.com Have?

We have procedures and security measures to prevent unauthorized access to and misuse of personal data.

We use appropriate business systems and procedures to protect your personal data. We also use security procedures and technical and physical restrictions for accessing personal data on our servers. Only authorized personnel have access to personal data in the course of their work.

We retain your personal data as long as necessary for your use or our provision of our services (including maintaining your user account with Tubber.com that you may have), to comply with applicable law, to resolve any disputes, and for other things that enable us to conduct our business activities, including detecting and preventing fraud and/or other illegal activities.

All personal data that we keep about you as a customer of Tubber.com falls under this Privacy Statement.

 

Combining Your Data

We use your contact data to communicate with you. To understand what is relevant for you, we use automated tools to analyze and combine your data. For this purpose, we may use the levels of personal data described above, including your booking data for sailing vacations (such as start date, date of checkout, destination, crew list data), paid extras (outboard motor, transfer), information about you, and the interests and preferences you have shared with us (such as favorite list like favorite yachts, restaurants, and destinations). We combine this data with data we collect with cookies and similar technologies when you visit our website or use our app. We merge it with data obtained through external providers using analytical or marketing cookies or related technologies. Without your consent, we will not use your sensitive data.

In our communications, we include personalized offers from our websites and our partners concerning our Sailing Vacations, Extra services, and products. For instance, we might include suggestions for our own paid extras (insurance, charts) or transfer services, insurances, and other related services offered by third parties. These offers are tailored to your interests. For example (unless you opt-out during the booking process), we might send you an email after you return from your sailing trip with offers based on your sailing history to inspire your next sailing vacation. With your permission, we may also share non-personal information (sailing destinations, travel date) with our partners so they can offer you a relevant choice of services, yachts, and boat tours during your trip. More information about our partners and the products and services they offer is given when you sign up and post on our websites.

We process your data as described in this section for our legitimate interest and the interests of third parties to provide you with relevant updates and offers.

 

Opt-in and Opt-out, Unsubscribing, and Right of Objection

We only send you emails with updates and special offers if you have not opted out during the sales process. You can unsubscribe at any time from these emails with updates and special offers by clicking the unsubscribe link in the email, adjusting your communication preferences in your account (if available), or by contacting us (see 'Your Rights' below). When you opt-out, you will still receive our booking and related service emails (such as your booking confirmation, voucher, password service emails, and review email).

 

Custom Audience Targeting

We may participate in Facebook's Custom Audience program, which allows us to display personalized ads on your timeline. With your permission, we may share your email address with Facebook so that Facebook can determine whether you have a Facebook account. To determine our audience, we may use your booking data from your sailing vacation. Your Data Internationally

Tubber may transfer your data to other countries, including countries outside the European Economic Area. This happens during the provision of your sailing vacation or because partners or service providers are active in countries worldwide. The laws of these countries may not offer the same level of data protection.

It may also be necessary for us to disclose your data to foreign public or government agencies.

To provide our services to you, it is often necessary for us to transfer your personal data to other countries. In other cases, Tubber will ensure that adequate safeguards are in place to comply with the requirements for the international transfer of personal data under applicable privacy legislation. For the transfer of personal data outside the European Economic Area, Tubber.com - if required - will use standard contractual clauses approved by the Commission as safeguards.

Laws in some other countries may require us to give border control agencies access to booking and sailing vacation travel information. Therefore, any information we have about you and your sailing vacation arrangements may be disclosed to customs and immigration authorities of each country in your itinerary. Moreover, some laws in various countries require that Tubber.com collects your passport number and related information before you travel to or from those countries. When necessary, we will provide this information to the relevant customs and immigration authorities. We may also disclose your data to government agencies if applicable law requires disclosure.

Depending on the law applicable to you, we may be asked to provide additional information. If applicable, you will find additional information for your country or region below.

 

Personal Data of Children

Our services are not intended for children under 18 years of age, and we will never collect their data unless provided by (and with the consent of) a parent or guardian. The limited cases when we must collect personal data of children under 18 years include: as part of a reservation, the purchase of other travel-related services, or in other exceptional circumstances (such as features aimed at families). Again, these are only used and collected if they are provided by a parent or guardian and with their consent.

 

Rights

You can contact us (see below) to exercise the rights granted to you under applicable data protection legislation, including (1) the right to access your data, (2) to have them corrected, (3) to have them erased, (4) to restrict the processing of your data, (5) the right to data portability, and (6) the right to object to processing.

  • Right to access: You can ask us whether we are processing your data and, if so, you can access those data in the form of a copy.
  • Right to rectification: You have the right to have your data rectified in case of inaccuracies or incompleteness. Upon request, we will correct incorrect personal data about you and, considering the purposes of the processing, complete incomplete personal data, possibly providing an additional statement.
  • Right to erasure: You also have the right to have your data erased, which means that your data will be deleted by us and, where possible, by any other controller to whom your data have previously been made public by us. The deletion of your data will only take place in a few cases as legally prescribed and mentioned under Article 17 of the General Data Protection Regulation (GDPR). This includes situations where your data are no longer needed for the original purposes for which they were processed as well as circumstances where they were processed unlawfully.

What are cookies and online tracking technologies?
